These terms govern use of the Rosify website and app to create, store, send and view digital gifts and the paid options available. Specific terms shown before you order a product, promotion or publication supplement this text. The Privacy policy explains data processing; reading it or accepting these terms does not amount to consent to advertising or content publication.

You must be at least 16 to create an account or submit content. If you are under 18, you need your legal representative’s authorisation to enter contracts where the law requires it. A minor’s participation in promotional content requires specific authorisation and the applicable legal safeguards; enabling an account preference is not sufficient.

2. Accounts, gifts and links

Provide accurate information, protect your access and tell us about unauthorised use. When creating a gift without an account, keep its link and any recovery options offered. Gift links may be accessed and forwarded by anyone who has them: they do not guarantee confidentiality. Sharing a link does not authorise Rosify to use the gift in its campaigns.

3. Rights in content you provide

You retain the rights you hold in letters, photos, drawings, audio, videos, music and other material you provide. Rosify retains its rights in its brand, software, designs and own assets. Including your creation in a Rosify production does not transfer ownership of your original material to Rosify.

You must hold the necessary rights or have sufficient permission for each use you request. This includes copyright, music, image, voice, privacy and personal data rights of people mentioned or depicted. Sending a gift does not make you the owner of the recipient’s rights. A song or video being available online does not authorise republication or commercial use.

You grant us a non-exclusive, royalty-free, worldwide licence limited to hosting, copying, processing, technically adapting and displaying or communicating your content to create and deliver the gift, store it as part of the service and allow its recipients to view it. This includes, for example, resizing a photo, rendering a video or playing selected audio. It lasts as long as necessary for these functions and the lawful retention described in Privacy; it does not authorise promotional use.

4. Permission for Rosify to use your creations in its own content

The permissions in Profile and permissions (Perfil y permisos) are independent and optional:

• Show my roses publicly (Mostrar mis rosas en público): allows the creations covered by your permission to appear in Rosify’s public gallery.
• Use them in online content (Usarlas en contenido online): allows their inclusion in Rosify’s own posts and videos on its online channels, including its website and Instagram, TikTok and YouTube profiles, to showcase the service and promote Rosify organically.

Within your chosen permission, you grant a non-exclusive, worldwide licence, without additional payment unless separately agreed, to reproduce, publicly communicate and adapt that material to those formats: excerpts, crops, edits, subtitles, translation and combination with our own or properly licensed assets. Adaptations must respect your moral rights, people’s dignity and the meaning of the content. We may use editing, hosting and platform providers only as necessary to carry out that authorised use.

The permission is limited to the creations and uses covered by the consent you gave; it does not cover all your future work or expand earlier permissions. It does not include paid advertisements, licensing to unrelated brands, standalone sales of your material or AI model training. Those uses require separate, specific authorisation. Nor does it replace permission from other identifiable people: before publication we must have the necessary rights and authorisations or exclude their data and images.

Your chosen public identity is respected. Anonymous mode hides the profile name; it does not remove names, faces or voices within the gift. Do not publish intimate or sensitive information, contact details or content involving minors through these general permissions.

5. Withdrawing permission or requesting removal

You can turn off each permission in Profile and permissions or write to contact@rosify.org, identifying the gift or publication if known. You will no longer authorise new uses for that purpose. We will remove the affected content from channels under our control without undue delay, except where retention is legally required, which does not authorise keeping it publicly available. Withdrawal does not make earlier processing based on valid consent unlawful.

Other users or platforms may have shared copies outside our control. We will cooperate with applicable removal requests, but cannot guarantee deletion of every external copy. A paid publication you commission is also governed by its specific terms and authorisation; it is separate from these optional permissions.

6. Prohibited uses and moderation

Do not submit unlawful content, threats, harassment, impersonation, sexual material involving minors, unauthorised intimate images, improperly obtained third-party data or material infringing rights. Do not attempt to access other accounts, bypass payment or security controls or disrupt the service.

We may reject or remove content and restrict accounts where necessary and proportionate to address an infringement, substantiated complaint, legal obligation or security risk. We will explain the measure and how to request a review, unless prohibited by law or a security risk. Publication of every creation, or any number of views, sales or earnings, is not guaranteed.

7. Prices, subscriptions and refunds

The product, price, currency, applicable taxes, duration and renewal conditions are shown before payment. Free features do not automatically include paid options. Subscriptions are managed through the purchase channel; cancellation stops renewals under the conditions shown. Rosicoins are service credits, not currency or an investment; statutory refund rights remain unaffected.

Consumers retain applicable rights concerning conformity, repair, replacement, price reduction, termination or refunds. The general withdrawal period for a distance purchase is 14 calendar days, unless a lawful exception applies. Immediate supply of paid digital content only permits loss of that right when the legal requirements are met, including prior express consent, acknowledgement of the loss and the required confirmation. Accepting these terms alone does not waive withdrawal rights.

To exercise withdrawal, send an unambiguous statement to contact@rosify.org with your name, order and purchase date. Personalised physical products, where offered, may be subject to a legal exception disclosed before purchase; this does not remove rights for defects or lack of conformity.

8. AI, external services and liability

AI features can produce inaccurate results, results similar to others or content needing review. Check the content and rights before sharing; exclusivity and copyright protection of every output are not guaranteed. External platforms and content are also subject to their own terms.

We exercise the care required by law, but interruptions or third-party changes may occur. We are responsible for our breaches and damage attributable to Rosify as required by law. Users are responsible for their own culpable breaches and proven damage they cause to the extent legally enforceable. These terms do not impose automatic indemnification, waive the right to bring claims or exclude liability or guarantees that cannot legally be limited.

9. Notices, changes and disputes

To report an infringement, send the link or identifier, an explanation, the rights affected and contact details to contact@rosify.org. Creators, recipients, people depicted and rights holders can report concerns. We may request proportionate information to verify them and will also review challenges to our decisions.

We may update these terms for legal or service changes, dating the revision and communicating material changes appropriately. Changes do not retroactively expand a licence or replace fresh consent where needed. Earlier purchases retain the terms applicable to them, except for lawful changes properly communicated.

Spanish law applies without depriving you of mandatory protections applicable where you live. You may use the courts and authorities competent under the law, including those where you live when applicable. There is no compulsory arbitration or waiver of legal action. The Spanish and English versions offer the same terms; any discrepancy will be resolved consistently with users’ mandatory rights.
